Terms of Service

Thank you for using Gogos Edu!

Effective December 1, 2025

These Terms of Service ("Terms") govern your access to and use of the Gogos Edu website, applications, and services (collectively, the "Platform"), operated by Gogos Edu Inc. ("Gogos Edu," "we," "us," or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

If you are using the Platform on behalf of an organization (for example, as a school or company), you represent and warrant that you have authority to bind that organization, and "you" and "your" will refer to that organization.

The Terms of Service include a class action waiver and a waiver of jury trials and require binding arbitration on an individual basis to resolve disputes.

The Terms of Service limit the remedies that may be available to you in the event of a dispute.

1. Gogos Edu Service

1.1 What we do.

Gogos Edu operates an online platform that:

  • connects students and their parents/guardians ("Students" and "Parents") with independent tutors ("Tutors");
  • provides tools for scheduling, messaging, video sessions, and file sharing; and
  • facilitates payment, credit bundles, and related support services (collectively, the "Services").

We do not guarantee any particular academic outcome, admission result, grade change, or test score improvement.

1.2 No direct teaching by Gogos Edu.

Tutoring services on the Platform are provided by independent Tutors, not by Gogos Edu employees. Gogos Edu itself does not provide instruction; we provide the infrastructure and tools to help Tutors and Students connect and transact.

1.3 User types.

"User" means any person or entity who accesses or uses the Platform, including:

  • Students;
  • Parents or legal guardians of Students;
  • Tutors; and
  • visitors who browse the site without creating an account.

2. Eligibility and Accounts

2.1 Minimum age.

You may use the Platform only if you:

  • are at least 18 years old and able to form a binding contract; or
  • are a minor whose account is created and managed by a Parent or legal guardian in compliance with these Terms.

2.2 Student accounts and Parents.

Accounts for Students under 18 must be opened and administered by a Parent or legal guardian.

The Parent is the legal party to these Terms and is responsible for:

  • all payments,
  • supervision of the Student's use of the Platform, and
  • ensuring compliance with these Terms.

2.3 Tutor accounts.

To use the Platform as a Tutor, you must:

  • apply and be approved by Gogos Edu;
  • provide accurate information about your identity, qualifications, and experience; and
  • complete any required verification or onboarding steps.

We may approve, deny, or revoke Tutor status at our sole discretion.

2.4 Account information.

You agree to:

  • provide true, accurate, and complete information during registration;
  • keep that information up to date; and
  • maintain the confidentiality of your login credentials.

You are responsible for all activities that occur under your account. Notify us immediately at support@gogosedu.com of any unauthorized use or suspected breach of security.

2.5 One account per person.

You may not create or maintain more than one account of the same type (e.g., multiple Tutor accounts) without our prior written consent.

3. Relationship Between Gogos Edu and Tutors

3.1 Independent contractors.

Tutors are independent contractors, not employees, partners, agents, or representatives of Gogos Edu. These Terms do not create any employment, joint venture, or franchise relationship.

Tutors are solely responsible for:

  • determining their own availability and teaching methods;
  • complying with all laws and regulations applicable to their teaching and business activities; and
  • paying all taxes, social contributions, and other obligations arising from their earnings.

3.2 No authority to bind Gogos Edu.

Tutors may not represent that they are employees or agents of Gogos Edu and may not enter into contracts or commitments on our behalf.

3.3 Off-platform services.

To protect the integrity of the Platform:

  • Tutors may not solicit or accept payment directly from Students/Parents for sessions identified or initiated through the Platform, except through the payment tools provided by Gogos Edu.
  • Students/Parents may not circumvent the Platform by arranging paid tutoring sessions directly with Tutors discovered through Gogos Edu.

We may suspend or terminate accounts that attempt to circumvent the Platform or our fees.

4. Booking, Credits, Fees, and Payments

4.1 Pricing and credits.

Session prices, Tutor rates, and credit bundle options are displayed on the Platform at the time of purchase. Gogos Edu may:

  • offer pay-per-session options;
  • offer credit bundles (prepaid credits that can be used to book sessions); and
  • provide promotions or discounts from time to time.

All prices are shown in U.S. dollars unless otherwise indicated.

4.2 Payment processing.

We use third-party payment processors (such as Stripe or similar services) to handle payments and payouts. By making or receiving payments through the Platform, you agree to:

  • the applicable terms and privacy policies of our payment processors; and
  • our sharing of relevant information (e.g., name, email, transaction details) with those processors.

We are not responsible for errors or delays caused by payment processors or banks.

4.3 Student / Parent payments.

  • You must have a valid payment method or sufficient credits to book a session.
  • When you confirm a booking, you authorize us (or our payment processor) to charge your payment method or deduct credits for the full amount shown at checkout, including any taxes or fees.

4.4 Cancellations and rescheduling.

The Platform may display specific cancellation and reschedule windows (for example, "free cancellation up to 24 hours before the session").

Those rules, as presented at checkout or in your plan details, are incorporated into these Terms.

If you cancel or reschedule outside the permitted window, you may forfeit your credits or payment; no refund will be due unless stated otherwise or required by law.

Tutors may also cancel sessions in case of emergency or unforeseen circumstances. In such cases, we may, at our discretion:

  • re-credit your account;
  • help you reschedule; or
  • issue another form of remedy, but are not obligated to provide any particular outcome.

4.5 Refunds.

Unless otherwise stated on the Platform or required by law:

  • payments and credits are non-refundable;
  • unused credits may expire in accordance with any expiration dates or promotional terms displayed at the time of purchase.

If we provide a voluntary refund or credit in one situation, it does not create an obligation to do so in the future.

4.6 Tutor earnings and payouts.

  • Tutors earn fees for sessions successfully completed through the Platform.
  • Gogos Edu may set, or allow Tutors to set within a range, session prices and payout rates.
  • We will deduct our service fee, transaction fees, and any applicable taxes or adjustments before remitting payouts.

Payouts are typically made according to the schedule and methods shown in your Tutor dashboard. We may withhold or adjust payouts in situations including, but not limited to:

  • chargebacks or payment disputes;
  • suspected fraud or misuse;
  • violation of these Terms or other Gogos Edu policies.

5. User Conduct and Acceptable Use

5.1 General expectations.

You agree to use the Platform in a respectful and lawful manner. You must not:

  • violate any applicable laws or regulations;
  • engage in harassment, bullying, hate speech, or discriminatory behavior;
  • share violent, sexually explicit, or otherwise inappropriate content;
  • impersonate any person or misrepresent your identity or qualifications;
  • interfere with the security or operation of the Platform.

5.2 Academic integrity.

Tutors and Students may not use the Platform to:

  • complete exams, graded assignments, or standardized tests on behalf of someone else;
  • obtain solutions that violate school or test-provider rules;
  • encourage cheating or other academic misconduct.

5.3 Off-platform contact and solicitation.

Without our explicit permission, Users must not:

  • share personal contact details (email, phone, social media, etc.) for the purpose of moving lessons or payments off the Platform;
  • advertise or solicit services that compete with or bypass Gogos Edu.

5.4 Safety and minors.

  • Tutors must maintain professional boundaries with Students at all times.
  • Any sexual, romantic, or otherwise inappropriate interaction with a minor is strictly prohibited and may be reported to authorities.
  • Parents are expected to supervise minors' use of the Platform and to review session history and communication where appropriate.

We may suspend or terminate accounts and, if necessary, report to law enforcement in cases of suspected abuse, exploitation, or other serious misconduct.

6. User Content and Licenses

6.1 User Content.

"User Content" means any content you upload, share, or create on or through the Platform, including:

  • messages, homework, files, and attachments;
  • notes, lesson materials, and slides;
  • profile information, photos, and reviews;
  • audio, video, or chat produced in sessions.

You are solely responsible for your User Content and for ensuring it complies with these Terms and applicable law.

6.2 Ownership.

Except as provided in these Terms, you retain all rights to your User Content.

6.3 License to Gogos Edu.

To operate and improve the Platform, you grant Gogos Edu a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to:

  • host, store, reproduce, display, and modify your User Content;
  • distribute your User Content within the Platform to relevant Users (for example, between Tutor and Student); and
  • use anonymized or aggregated forms of your User Content for analytics, product improvement, and marketing (for example, "Students spent X hours this month studying algebra").

We will not publicly use your identity (name, photo) for marketing without your consent, except where you intentionally make such information public (e.g., Tutor profile).

6.4 Prohibited content.

User Content must not:

  • infringe any copyright, trademark, privacy, or other rights of any third party;
  • contain defamatory, obscene, or unlawful material;
  • promote self-harm, hate, or illegal activities;
  • include personal data of others without lawful basis and consent where required.

6.5 Monitoring and removal.

We may, but are not obligated to:

  • review, monitor, or moderate User Content;
  • remove or restrict access to any User Content that violates these Terms or creates risk for other Users or Gogos Edu;
  • suspend or terminate accounts associated with such content.

7. Session Technology and Recordings

7.1 Third-party tools.

Sessions may use third-party video conferencing, whiteboard, and collaboration tools. Your use of such tools may be subject to additional terms and privacy policies from those providers.

7.2 Recordings.

  • Some sessions may be recorded (audio, video, and/or chat) for quality, safety, training, and dispute-resolution purposes.
  • Where required by law, we will notify you that a session is being recorded.
  • By participating in a recorded session, you consent to such recording and to our use of the recordings as described in our Privacy Policy and these Terms.

7.3 Access to recordings.

Recordings may be made available to:

  • the Student and/or Parent;
  • the Tutor who conducted the session;
  • Gogos Edu staff or service providers who need access for support, safety, or product improvements.

We will not sell recordings or share them publicly without your consent, except as required by law or to protect the rights, property, or safety of Gogos Edu, our Users, or others.

8. Intellectual Property; Platform License

8.1 Our IP.

The Platform, including its design, software, text, graphics, logos, and other content (excluding User Content), is owned by Gogos Edu or its licensors and is protected by intellectual property laws.

8.2 Your license to use the Platform.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial educational purposes (or, in the case of Tutors, for providing tutoring services on the Platform).

You may not:

  • copy, modify, or create derivative works of the Platform or its content (other than your own User Content);
  • reverse engineer, decompile, or attempt to extract source code;
  • use automated tools (bots, scrapers) that access the Platform in a way that burdens or disrupts our systems;
  • remove or alter any copyright, trademark, or other proprietary notices.

8.3 Feedback.

If you send us feedback, ideas, or suggestions about the Platform ("Feedback"), you agree that we may use it without restriction or compensation to you. You hereby assign to Gogos Edu all rights in such Feedback.

9. Third-Party Sites and Services

The Platform may contain links to or integrations with third-party websites, tools, or services ("Third-Party Services"). We are not responsible for:

  • the content, policies, or practices of Third-Party Services; or
  • any products or services they offer.

Use of Third-Party Services is at your own risk and subject to their own terms and privacy policies.

10. Suspension and Termination

10.1 By you.

You may stop using the Platform at any time. To request account deletion, contact us at support@gogosedu.com. Certain information may be retained as required by law or to enforce these Terms.

10.2 By Gogos Edu.

We may suspend or terminate your access to the Platform, with or without notice, if we believe that you:

  • have violated these Terms or other policies;
  • have engaged in fraud, abuse, or harmful behavior;
  • present a risk to other Users or to Gogos Edu.

Upon termination:

  • your right to use the Platform ends immediately;
  • we may deactivate or delete your account and User Content (subject to our retention obligations and rights);
  • provisions of these Terms that by their nature should survive will continue to apply (including payment obligations, disclaimers, and limitations of liability).

11. Disclaimers

To the fullest extent permitted by law:

  • The Platform and Services are provided "as is" and "as available".

We do not make promises about:

  • uninterrupted or error-free operation;
  • specific academic results, admissions outcomes, or test scores;
  • the quality, reliability, or availability of any Tutor or session.

You use the Platform and engage with Tutors at your own risk.

Tutors are independent and are not controlled by Gogos Edu in how they teach. We do not supervise every session or verify every statement made by Tutors or Students.

12. Limitation of Liability

To the fullest extent permitted by law:

Gogos Edu and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Platform.

Our total liability for any claim arising out of or related to these Terms or the Platform will not exceed the greater of:

  • USD $100, or
  • the total amount you paid to Gogos Edu in the six (6) months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. In those cases, the limitations will apply to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless Gogos Edu and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

  • your use of the Platform or Services;
  • your User Content;
  • your violation of these Terms; or
  • your violation of any applicable law or third-party rights.

14. Dispute Resolution and Arbitration

This section includes an agreement to arbitrate disputes and a waiver of class actions. Please read it carefully.

14.1 Informal resolution.

Before filing any formal claim, you agree to first contact us at legal@gogosedu.com and attempt in good faith to resolve the dispute informally.

14.2 Agreement to arbitrate.

If we cannot resolve the dispute within thirty (30) days, you and Gogos Edu agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform will be resolved by binding arbitration on an individual basis, except that:

  • either party may bring an individual action in small-claims court; and
  • either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement or misuse of intellectual property or confidential information.

14.3 No class actions.

You and Gogos Edu agree that:

  • disputes will be resolved only on an individual basis; and
  • neither party will bring or participate in any class, collective, or representative action or proceeding.

14.4 Arbitration rules and forum.

Arbitration will be conducted by a recognized arbitration provider (such as JAMS or AAA) under its applicable rules. Unless you and Gogos Edu agree otherwise:

  • the arbitration will be conducted in San Francisco, California; and
  • the language of the arbitration will be English.

14.5 Governing law.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent that the laws of your country of residence require different rules for consumer contracts and cannot be waived.

If the agreement to arbitrate is found not to apply to you or your claim, you agree to the exclusive jurisdiction of the state and federal courts located in San Francisco, California for any judicial proceedings.

If any part of this Section 14 is found unenforceable, the remainder will stay in effect to the fullest extent permitted by law.

15. Changes to the Platform and Terms

We may modify or discontinue parts of the Platform at any time.

We may also update these Terms from time to time. When we do, we will change the "Effective date" at the top and, where required by law or materially impactful, provide additional notice (for example, via email or an in-app message).

If you continue to use the Platform after the updated Terms take effect, you are indicating that you accept the updated Terms. If you do not agree, you must stop using the Platform.

16. Miscellaneous

16.1 Entire agreement.

These Terms, together with any policies or guidelines referenced in them (such as our Privacy Policy), constitute the entire agreement between you and Gogos Edu regarding the Platform and Services.

16.2 Severability.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 No waiver.

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

16.4 Assignment.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.

16.5 Notices.

We may send notices to you by email, through the Platform, or by posting on our website. You may send notices to us at:
